The host also provides the website's audience measurement (Vercel Web Analytics), described in Article 7.

No other third party is involved in displaying the pages: fonts, scripts and images are served from the publisher's domain.

5. Intellectual property

All the elements making up this website (structure, text, visual identity, logo, illustrations, animations, source code and layout) are the exclusive property of the publisher or are used under an authorization of use. These elements are protected by the Code de la propriété intellectuelle (French Intellectual Property Code).

Any reproduction, representation, adaptation or exploitation, in whole or in part, by any process and on any medium whatsoever, without the prior written authorization of the publisher, is prohibited and constitutes the offense of infringement (délit de contrefaçon) within the meaning of Articles L. 335-2 et seq. of the Code de la propriété intellectuelle.

Any third-party trademarks and logos mentioned remain the property of their respective owners.

6. Personal data

The publisher acts as controller for the data collected through this website, in accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of January 6, 1978, as amended (the French Data Protection Act).

Data collected and purposes

Clients, prospects and workshop participants

Outside the website, the publisher processes the data of its clients, its prospects and their contact persons, as well as that of participants in audit workshops:

In addition to the service providers listed below, these processing operations involve the following processors: DocuSeal, LLC (electronic signature of quotes and contracts on docuseal.eu, servers in Ireland, company established in the United States); tl;dv (recording and transcription of audit workshops, European Union); Tally (audit preparation form, servers in Germany); AssemblyAI, Inc. (transcription of meetings, United States); Cloudinary (storage of meeting recordings, United States). Accounting records are sent to our chartered accountant.

Recipients

The data collected through the website is intended for the publisher. It may be processed by the following technical service providers, acting as processors: Vercel Inc. (website hosting, United States); n8n GmbH (running the assistant and handling requests, Germany); OpenAI Ireland Limited (the assistant's language model and assistance in drafting replies, models run in the United States); Pinecone Systems Inc. (search in the assistant's knowledge base, company established in the United States); Supabase Pte. Ltd (database of requests, servers in Ireland, company established in Singapore); Google (email, calendar and video conferencing, European Union and United States). No data is transferred or sold to third parties for commercial purposes.

Transfers outside the European Union

Some of these service providers are established outside the European Union, in the United States or Singapore, or process data there: the website host, the developer of the assistant's language model, the assistant's document search service, our database (whose servers are in Ireland), our email service, the meeting transcription service and the storage of meeting recordings. These transfers are governed by the appropriate safeguards provided for in Chapter V of the GDPR: the adequacy decision on the EU-U.S. Data Privacy Framework for recipients certified under it (Vercel, Google, AssemblyAI, Cloudinary), failing which the European Commission's standard contractual clauses (OpenAI, Pinecone, Supabase). A copy of these safeguards is provided to you upon request at contact@ds-intelligence.tech. Electronic signature takes place on docuseal.eu, whose servers are located in Ireland. No website resource (font, script, image) is loaded from a third-party server.

Retention period

Conversations with the assistant are kept for as long as necessary to handle the request, then for twelve months at most. The developer of the language model may retain conversations with the assistant for a limited period (thirty days under its current policy), for security and abuse-prevention purposes, without using them to train its models. Contact requests are kept for the duration of the business relationship, then for three years from the last contact for prospecting purposes. Traffic statistics are kept in aggregated form for one year.

Your rights

You have a right of access, rectification, erasure, restriction, objection and portability regarding the data concerning you. These rights are exercised by email to contact@ds-intelligence.tech, together with any information allowing your identity to be verified.

Right to object. You may object at any time, without having to give reasons, to the use of your data for prospecting purposes and, on grounds relating to your particular situation, to processing based on our legitimate interest. Every prospecting message includes a simple way to object.

The fields marked with an asterisk are required to book a call or handle your request: without them, we cannot follow up on it. No decision producing legal effects concerning you is taken solely on the basis of automated processing. A copy of the safeguards governing transfers outside the Union is provided to you upon request at contact@ds-intelligence.tech. You may also set out instructions regarding what happens to your data after your death.

If, after contacting us, you believe that your rights are not being respected, you may lodge a complaint with the CNIL, the French data protection authority (3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France).

7. Cookies and trackers

This website does not set any advertising, tracking or audience measurement cookies, nor any third-party trackers. Only one cookie is set, and it is strictly necessary: lang, which remembers for one year the language you chose (French or English) with the FR / EN switcher. The CNIL exempts trackers that store a language choice from consent: no consent is therefore required, and no banner is shown to you.

Audience measurement

The website counts its visits using Vercel Web Analytics, its host's measurement tool. The script is served from the publisher's domain, sets no cookies and writes nothing to your device.

To tell two visits apart without identifying anyone, the host computes, from the request sent by your browser, a hash that is erased after twenty-four hours. The statistics recorded are linked neither to a person nor to an IP address, and do not allow any tracking from one website to another. You may object to this measurement by blocking this script in your browser: this does not affect your use of the website.

This measurement is used solely for statistical monitoring of traffic on this website, to the exclusion of any profiling and any cross-referencing with other processing. On that basis, it falls within the consent exemption allowed by the CNIL for audience measurement.

Local storage

The website also uses your browser's session storage (sessionStorage) to keep, for the duration of your visit, a random technical identifier and a flag that avoids showing you the assistant's invitation twice, both strictly necessary for the chat assistant to work. This data is erased when you close the tab and does not allow any tracking across websites.

8. Liability

The publisher strives to ensure that the information published is accurate and up to date, but cannot guarantee that it is free of errors or omissions. Information presented for guidance only, including prices, does not constitute a contractual offer: only an accepted quote is binding on the parties.

The publisher cannot be held liable for any direct or indirect damage resulting from access to the website or its unavailability, or from the use made of the information it contains.

9. Hyperlinks

The website may contain links to third-party websites. The publisher has no control over their content and disclaims all liability with respect to them. Linking to this website does not require prior authorization, provided that the link does not harm the publisher's image.

10. Governing law

This legal notice is governed by French law. Failing an amicable resolution, any dispute relating to its interpretation or performance falls within the jurisdiction of the French courts.
